LABOR LAW POSTING COMPLIANCE
The following questionnaire has been prepared by HRdirect as a service to employers to help them determine their compliance with federal and/or state labor law posting regulations. "Yes" is the only answer to all five questions that indicate your compliance. If you answer "No" or "Not sure" to any of the questions, you may be risking penalties for non-compliance with posting regulations.
COMPLIANCE QUESTIONNAIRE
1. Federal regulations mandate that you display required labor law posting in a location conspicuous to employees, at each of your company's work facilities.
Do you have such postings for your employees at all facilities?
2. The law also requires that you display certain postings for job applicants as well as for employees. This means that you must have two sets of postings at locations where applicants and employees occupy different areas.
Do you have these duplicate postings at all required locations?
3. Employee postings under federal law must cover: Equal Employment Opportunity; Job Safety and Health Protection; Federal Minimum Wage (including Child Labor); the Employee Polygraph Protection Act; and, (for companies with at least 50 employees within 75 miles) the Family Medical and Leave Act.
Do your postings cover all these subjects?
4. Your postings must also be up-to-date as required by law... including, for example, the Americans with Disabilities Act; the Family and Medical Leave Act of 1993 (for covered companies); the latest minimum wage, etc.
Are all your current postings up-to-date in all areas of the law?
5. Your state may require that, in addition to posting federal laws, you post some or all of the following state laws:
Fair Employment, Payday Notice, OSHA/Healthcare, Time Off to Vote, Emergency Phone Numbers, Minimum Wage, Worker's Compensation, Pregnancy Leave, Family Leave, Unemployment Insurance, Access to Medical Records, Hazardous Chemicals Data Sheet, Whistle blowers Protection Act, Parental Leave, Public Accommodation, Benefit Rights/Labor Dispute, Benefit Rights/Vacation, Sexual Harassment, Layoff Notice, Lie Detector Test, Video Display Terminal, Sickle Cell Anemia, Minor Labor Law and/or Safe Practice.
Are you in compliance with these requirements?
In addition to Federal laws, Texas Posting Requirements include the following from the above list.
WORKER'S COMPENSATION, UNEMPLOYMENT INSURANCE, MINOR LABOR LAW, PAYDAY NOTICE, EMERGENCY NUMBERS, WORKER'S COMPENSATION COMMUNICABLE DISEASES.
